Penalty on auto parts imports stayed, IHC

Used Auto Parts Association Pakistan (“Association”) has been disputing the Customs Department’s insistence on imposing penalty 100% of the value of goods imposed through the Finance Act, 2023. AHR & Co filed multiple writ petitions in the IHC. Lead counsel Mr. Adnan Haider Randhwa argued that heavy penalty was to curb smuggling of used auto parts and not the lawful trade. The IHC directed Chairman FBR, Secretary Commerce and Secretary Industries to jointly hold a meeting with the Association and resolve the dispute. As an interim relief, the Collector Customs was directed to release all the containers on payment of duties/taxes, fines and penalties as were charged before amendment inserted by the Finance Act, 2023.
